Members

There is hereby created a Zoning Board of Adjustment consisting of five members, each to be appointed for a term of three years and removable for cause by the City Council upon written charges and after public hearings. Vacancies shall be filled for the unexpired term of any member whose term becomes vacant. It is specifically provided, however, that on the effective date of this chapter, such Board of Adjustment as was legally in existence immediately prior to such date shall be constituted as the Board of Adjustment hereby created, and the terms of the then members of said Board shall expire after a period of three years, or continue until their successors are duly appointed and qualified. Said Board of Adjustment shall be appointed by the Mayor and confirmed by the City Council.

§ 361-127 Appeals to Board of Adjustment; fee

Appeals to the Board of Adjustment may be taken by any person aggrieved or by any officer of the municipality affected by any administrative decision based on chapter 361 of the Code. Appeals can be filed in the Community Development Department with a fee and a filing period. Notice will be given to surrounding property owners and to the board. The Zoning Board of Adjustment shall establish a fee for the hearing of appeals, which shall be sufficient to defray the cost of publishing the notice of public hearing and any other costs associated with the hearing. The appellant shall pay for such fee upon filing the appeal.

Variances with regulations

Variance is filed with the Board of Adjustment. Variances may be issued for new construction and substantial improvements to be erected on a lot of 1/2 acre or less in size contiguous to and surrounded by lots with existing structures constructed below the base flood level. The appeal board may attach such conditions to the granting of variances as it deems necessary. Variances shall not be issued within any designated floodway if any increase in flood levels during the base flood discharge would result. Variances may be issued for the repair or rehabilitation of historic structures upon a determination that the proposed repair or rehabilitation will not preclude the structure's continued designation as a historic structure and the variance is the minimum necessary to preserve the historic character and design of the structure.
